The Law

Under the Smoke-Free Ontario Act, 2017, smoking and vaping any substance—including tobacco, cannabis, and vapour products—is prohibited in enclosed workplaces, workplace vehicles, and public spaces. This law protects workers and the public from exposure to second-hand smoke. Learn more at ontario.ca/smokefree

EMPLOYERS

Employers must:

  • Ensure compliance with the Smoke-Free Ontario Act.
  • Address non-compliance; direct individuals to leave the premises if needed.
  • Clearly identify no-smoking/vaping areas by posting
    required signage.
  • Ensure there are no ashtrays in the enclosed workplace.

 

Employers are subject to fines for failing to comply.

EMPLOYEES

Employees must not:

  • Smoke or vape ANY substance.
  • Hold lit tobacco or cannabis.
  • Use or hold an activated vaping device.


Employees are subject to a fine of $305 for failing to comply with the above.

VEHICLES

Any roof-covered vehicle used for employment is
considered a workplace, including:

  • Taxis, delivery vehicles, heavy equipment
  • Vehicles used outside work hours
  • Personal vehicles with workplace branding

Workplace vehicles have the same requirements as other enclosed workplaces, including:

  • Posting all required signage or stickers.
  • Employers to ensure compliance with the Smoke-Free Ontario Act.
  • Any applicable fines.

SHELTERS

Employers may provide a shelter if it:

  • Has no more than 2 walls and a roof.
  • Is fully outdoors.
  • Meets any additional rules for certain workplaces
    (For example, no smoking on hospital property).

 

Use of non-compliant shelters could result in fines to the employer, employees, or members of the public.
